Terms and Conditions
1. Scope and definitions
Finest Escape GmbH (referred to below as “Finest Escape”), Bucher Str. 76, 90408 Nürnberg, offers interested persons (referred to below as the “customer”) services and products relating to escape games and city rallies. The following Terms and Conditions exclusively and comprehensively govern the formation and performance of the contract.
2. Subject matter of the contract
2.1 The contract covers the provision of the leisure events offered. Finest Escape offers leisure activities for groups of between 2 and 200 people in the form of escape games and city rallies. Customers making bookings must be at least 16 years old. Minors may enter into a paid contract only in accordance with the law and with the necessary consent of their legal representatives. The group taking part may include younger participants. Participants under 14 must be accompanied to the venue by an adult on the day of the event. The aim of the activities is to solve tasks and puzzles together as a team. The experiences have a fixed duration, which is stated during booking. For escape games, the venue is a specially equipped room that a group can book for its exclusive use. For city rallies, the venue is a specified route through public spaces, which the group explores independently. No prior knowledge or particular physical characteristics (such as height or strength) are needed to solve the puzzles; ingenuity and skill are required. Game masters provide targeted assistance when needed.
2.2 The event starts at the agreed time and place. We recommend arriving 15 minutes beforehand. If you arrive late, we assess whether the game can still be run with reduced playing time, or whether individual late participants can still join, safely and where organisationally feasible and reasonable. A minor delay does not automatically result in exclusion. There is no entitlement to postpone the start or extend the game beyond its agreed end. If the delay makes participation impossible or unreasonable, any statutory claim for payment or compensation is governed by section 4.3; the customer’s statutory rights remain unaffected.
3. Formation of the contract
You may book a game through the website, by telephone or by email.
3.1 Finest Escape’s website (www.finest-escape.de) offers escape games and city rallies for booking, together with monetary value vouchers for these activities. Presenting and advertising the activities does not constitute a binding offer to enter into a contract. Customers can choose from the events offered. Available appointments are shown in the calendar. To make a booking, Finest Escape first asks for information such as the customer’s name, email address, telephone number and, where applicable, billing address. By clicking “zahlungspflichtig bestellen” (“order with an obligation to pay”), the customer submits a binding offer to enter into a contract. Before submitting the booking, the customer can review and amend their entries at any time. The customer can print and save these Terms and Conditions using their browser. After the order is submitted, Finest Escape sends a booking confirmation by email. The contract is formed when this booking confirmation is issued. The customer must check it promptly and inform Finest Escape of any errors.
If a voucher has been ordered, the voucher code is provided in the booking confirmation email. This entitles the customer, or a person to whom the customer passes the value voucher, to use the voucher amount as payment when booking escape games and city rallies and when paying for the game at the venue.
Input errors can be corrected using the usual keyboard, mouse and browser functions, such as the browser’s Back button. A selected appointment is reserved for 15 minutes and released for booking again if the booking is not completed.
3.2 When booking by telephone, the customer can also choose from the events offered and must provide the required information over the telephone. The customer can print and save these Terms and Conditions using their browser. After the telephone booking, Finest Escape emails a booking confirmation setting out the booking and the customer’s personal details. The contract is formed when this booking confirmation is issued. The customer must check it promptly and inform Finest Escape of any errors.
3.3 When booking by email, the customer chooses from the available events and must provide the required information by email. The customer can print and save these Terms and Conditions using their browser. After the booking, Finest Escape emails a booking confirmation setting out the booking and the customer’s personal details. The contract is formed when this booking confirmation is issued. The customer must check it promptly and inform Finest Escape of any errors.
3.4 The contracting party is Finest Escape GmbH, Bucher Str. 76, 90408 Nürnberg.
4. Cancellation, non-attendance, booking changes and refunds
4.1 The customer may cancel the contract free of charge up to 72 hours before the agreed start of the game. The time at which the provider receives the cancellation notice is decisive.
4.2 For a cancellation less than 72 hours but at least 48 hours before the agreed start, we claim only payment or compensation to which we are entitled under the statutory requirements, capped at €50.00. Saved expenses, income from a replacement booking of the released slot and other earnings that must be credited by law are deducted. The same loss will not be compensated twice. The customer remains entitled to demonstrate that no claim or a lower claim exists.
4.3 For a cancellation less than 48 hours before the agreed start, or a no-show, the agreed fee remains payable only insofar as a statutory claim for payment or compensation exists. We deduct saved expenses, income from a replacement booking of the released slot and other earnings that must be credited by law. The same loss will not be compensated twice. The customer remains entitled to demonstrate that no claim or a lower claim exists. No flat claim for the full booking price is agreed.
4.4 Rescheduling is possible free of charge up to 72 hours before the agreed start, subject to availability. For an agreed rescheduling less than 72 hours but at least 48 hours beforehand, we claim for the cancelled original slot only payment or compensation to which we are entitled under the statutory requirements and the deduction and evidence provisions of section 4.2, capped at €50.00. No additional flat administration fee is charged. There is no contractual entitlement to rescheduling less than 48 hours before the start. Individual agreements and statutory rights remain unaffected.
4.5 The customer may nominate a suitable replacement participant. This does not entitle the customer to a reduction in the booking price.
4.6 If individual participants arrive late, section 2.2 applies. They are excluded only insofar as participation is no longer safe, organisationally feasible or reasonable. Any price adjustment for absent participants is governed by the agreed pricing method and statutory provisions. Statutory rights to refunds and price reductions remain unaffected. There is no entitlement to extend the agreed playing time.
4.7 Statutory rights to rescind or terminate the contract remain unaffected. There is no statutory right of withdrawal for leisure services booked for a specific date under section 312g(2), no. 9 of the German Civil Code (BGB).
4.8 Cancellations and requests for changes may be sent in particular by email to nuernberg@finest-escape.de or bamberg@finest-escape.de. The time of receipt is decisive. Other legally permitted methods of giving notice are not excluded.
4.9 For team events outside our regular opening hours that have been expressly agreed as special bookings, the following applies instead of sections 4.1 to 4.3: cancellation is free of charge up to seven days (168 hours) before the agreed start. If cancellation occurs later, the agreed fee remains payable insofar as a statutory claim for payment or compensation exists. We deduct saved expenses, income from another booking of the released slot, and other earnings that must be credited by law. The customer remains entitled to demonstrate that no claim or a lower claim exists. Statutory rights to rescind or terminate the contract remain unaffected. The special booking and this different cancellation period are expressly communicated before the contract is concluded.
5. Fees and payment
The fee depends on the size of the group and the time booked. The amount is shown during the ordering process and includes statutory VAT. Payment becomes due upon the booking confirmation.
For online payments, the payment methods displayed in the relevant checkout are available. Where payment at the venue is agreed, payment is made at the beginning of the event in cash or by debit or credit card.
6. Vouchers
Our vouchers are monetary value vouchers for the amount chosen at purchase. They are not tied to a fixed number of participants or a particular game; the redemption options stated when ordering apply. The voucher amount is credited against the price of the booked service. The prices for the selected game and group size apply. If the booking price exceeds the available credit, the difference must be paid. The voucher value includes statutory VAT where applicable. Voucher credit cannot be exchanged for cash; statutory rights to repayment and withdrawal remain unaffected. Claims arising from vouchers purchased for payment are subject to statutory limitation periods. The standard limitation period is three years and generally begins at the end of the year in which the claim arose and the statutory requirements for commencement of the limitation period are met. Statutory provisions on suspension and recommencement remain unaffected. Statutory rights to repayment and withdrawal are not restricted by this provision.
7. Liability and safety information
We accept unlimited liability for damage arising from injury to life, body or health caused by an intentional or negligent breach of duty by us, our legal representatives or persons assisting us in performing our obligations. For other damage, we accept unlimited liability in cases of intent and gross negligence, within the scope of any guarantee we have given, and where liability is mandatory by law.
In cases of ordinary negligence, we are otherwise liable only for a breach of an essential contractual obligation. Essential obligations are those whose performance makes proper fulfilment of the contract possible and on whose performance the customer may ordinarily rely. In such cases, liability is limited to foreseeable damage typical of the contract.
These provisions also apply to damage to belongings and clothing brought to the venue. Information about the typical requirements or risks of a game does not restrict statutory liability beyond these provisions.
Technical equipment such as 12-V magnets and flickering lights, as well as natural products, may be used on the premises. These can cause symptoms, particularly in people with epilepsy or allergies. Please read the information for the particular game and contact us before booking if you have questions about its suitability.
8. Privacy and data processing
Information about the processing of personal data when you contact us, book, pay or take part in a game is available in our Privacy Policy. Consent to optional advertising or the publication of recordings is not part of these Terms and Conditions.
9. Prohibited customer conduct
9.1 All events in the rooms and the rooms themselves are protected works under section 2 of the German Copyright Act. Photography and film, video or audio recording are prohibited. In the event of an unauthorised recording of all or part of an event, Finest Escape will file a criminal complaint with the law enforcement authorities.
9.2 Bringing food or drink into the event room, or consuming food or drink brought from elsewhere anywhere on the premises, is not permitted.
9.3 Smoking is prohibited in all areas of the venue.
9.4 Finest Escape may refuse admission if there is reason to believe that, because of alcohol or drug use or for other reasons, the person concerned will disrupt the event or normal business operations or harass other visitors.
9.5 Pets are generally not permitted. Statutory rights of access apply to people with disabilities accompanied by an assistance dog, in particular section 12e of the German Act on Equal Opportunities for Persons with Disabilities (BGG). Please contact us in advance where possible so that we can coordinate safe participation in the particular game. Advance notification is not an additional condition of the statutory right of access.
10. Removal from the premises and bans
If a visitor breaches the provisions in sections 8 and 9 above, Finest Escape may require that visitor to leave the premises. Without prejudice to its other rights, Finest Escape may impose a temporary or permanent ban in individual cases of serious or repeated disruption or breaches of these provisions.
11. Required customer conduct
11.1 Customers must use the premises, particularly the furnishings and equipment in the game rooms, with care throughout their visit. Finest Escape reserves the right to pursue civil claims for any culpably caused damage and, in the case of intentional damage, criminal proceedings as well.
11.2 Any items found at the venue must be handed to staff.
11.3 Customers must follow the instructions of Finest Escape staff and refrain from disrupting operations in any way. Mobile phones, other electronic communication devices and audible signalling devices of any kind are not permitted in the game rooms. Optical pointing devices (laser pointers) are prohibited. To ensure an undisturbed event, Finest Escape may require a user of any such device to switch it off immediately or require the customer to leave the event.
12. Audio recordings, photography and filming
12.1 Photography and video or audio recording in the game rooms are not permitted without our prior permission. Recording equipment and cameras may not be taken into the puzzle rooms and must be left at the cloakroom for safekeeping. The liability provisions in section 7 apply to safekeeping.
12.2 In the event of a breach, we may require recording to stop and take necessary, proportionate measures under our right to control access to the premises. Statutory claims for injunctive relief and damages remain unaffected. No general right to confiscate private devices or delete their contents without authorisation is agreed.
12.3 These Terms and Conditions do not constitute consent to taking or publishing customer photographs or audio or video recordings for advertising purposes. Where required, we obtain separate, voluntary consent from the persons concerned. Live observation and the storage of video images are described separately in section 14.
13. Trade secrets
The solutions to the puzzles in the rooms are Finest Escape trade secrets and must not be disclosed to third parties. In the event of a breach, Finest Escape will take legal action against the person responsible and claim compensation for all damage.
14. Images and camera footage during the activities
During games, game masters observe the game rooms on a screen to guide the game and respond to safety issues. In addition, video images are recorded in the game rooms, entrance and lounge areas and stored locally on SD cards for three days. Audio is not stored. Only the company management has access to the stored recordings.
Video surveillance serves the safety of customers and staff and protection against unauthorised access and theft. Recording and storage of video images are distinct from live observation.
These Terms and Conditions do not constitute consent to video surveillance. Information about the controller, purposes, legal bases, retention period and your data protection rights is available in the “Video surveillance at our locations” section of our Privacy Policy.
15. Applicable law and jurisdiction
The law of the Federal Republic of Germany applies exclusively.
If the customer is a merchant and has its registered office in Germany at the time of booking, the exclusive place of jurisdiction is the registered office of Finest Escape GmbH in Nuremberg.
16. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
